Student Question on Sale of Goods and defintion of a consumer

Wondering if anyone can help:

Within the SoGA 1979 is a consumer as defined in s.12 UCTA 1977 where they can be a natural or legal person or is it as per reg 2. in Unfair Terms in Consumer Contracts Regulations 1999 where they can only be a natural person.

What I really want to know is can a small business who is not contracting in the course of their business (i.e. a shoe shop buying a loo roll as opposed to Birkenstocks) claim to be a consumer under SoGA 1979? I thought they could but am now starting to doubt myself.

Would appreciate any help.....
