advice on bankruptcy and repossesion please

i havent a clue where to start so i apologise if this is long winded!
me and husband split a couple of months ago, he dropped the kids off today and left me with by the way i am making myself bankrupt and the house will be reposessed, the mortgage is in both names i am on a council register what do i do now, does his bankruptcy affect me? i have my own bank accounts etc we never got round to getting joint ones thank god. has anyone been through this? i need some advice please.

Have you applied for income support? If so, you could apply for help with home costs, which, after a 39 week wait, means that your mortgage interest payments will be covered. His bankruptcy can affect you, but you may be able to put off the repossession of the house for a while.

Alternatively it might be better to let the lender repossess because once you get an eviction notice, the local authority will have to class you as homeless.

I do not know the exact procedure on this issue becuase it depends so much on individual circumstances. However, I do work for an charity where we deal with a lot of people in financial difficulty.

The two strong and consistent pieces of advice we always give are:

  1. Strongly advise you to seek urgent help from Cititizens Advice Bureau so you can understand your rights. Make an appointment tomorrow morning as they are overwhelmed at the moment and it may take a while but they may prioritiee you because you are in a vulnerable position with children.
  1. Strongly advise you never voluntarily make yourself homeless. Contact the council tomorrow morning and and tell them your situation and DO wait to be formally evicted. You have to be MADE homeless in order to get rehoused by the council. Do not just walk away from the house or just hand back the keys to the bank.

you may not lose your home if there is little or no equity in it. You may be able to buy him out for £1 - providing you can afford the mortgage on your own.

Go over to the forums on bankruptcy on www.debtquestions.co.uk - there is masses of information - also contact the cccs www.cccs.co.uk as there is sometimes a huge wait for a specialist debt advisor at CAB
