Small Claims Court: what does it entail?

Can you please give tips me how to go about taking someone to Small Claims Court?

I hear that it is quite easy.

What was your experience of it like?

TIA.

Yes it is quite easy, just fill in a form.

It can take a while to get a court date that's all and even if you get a ruling it doesn't mean the other side pays up and then you have to go back to court and it starts to get complex and costly.

Is it a business or a person you want to act against?

foxytocin · 25/03/2009 09:37

business. BA to be exact.

Ah then you are probably quite screwed - could ABTA help you? What did they do?

Good luck. I'm currently trying to get compensation from Royal Mail through Small Claims. I've been through everything and more since last October and now the Court has sent me a stupid letter I have no clue about, due to legalese jargon. Looks like I either give up or pay a solicitor, which I can't afford to do.

The route is easy enough, the forms are straight forward, but I'm thinking that the big companies know that we minions have little or no legal knowledge, nor the money to fight them so they'll push until we cave. You'll probably need to grit your teeth and be prepared to fight!

why are you taking them to court? dont be put off by the fact that they are a big company my mum took eoither thomas cook or thompsons to court over a crap holiday and she won

Shadownto - May I suggest you call the court and ask to speak to a court administrator and ask them to explain the letter - they will gladly explain what it means.

Shadownto · 27/03/2009 08:01

whomovedmychocolate - have done that, but they can only explain so much. They've explained the jargon, but I don't know what I've missed so don't really know how to proceed.
