I need your help. I've been given notice to move out of my house by the agency but I really want to stay. Any ideas?

The rent was late going into their account as the bank told me it would take 1-3 days for it to show, it didn't. I've been late paying before so they have given me notice. I've had a kidney stone for the past three weeks so I'm in almost constant pain, I feel to ill to move house, ds is settled here and I can't see any sympathy from them. I'm going to pay it in myself next month to make sure it goes in on time but I don't think this will make any difference.

Any ideas will be really helpful please

Is your landlord a social landlord or a private one?

What sort of tenancy do you have?

What notice have they given you ie how far have they got in the process?

It's a private landlord (an agency), they have given me until the end of April, it's a rolling tenancy? I've been here for 6 years so it's rolled on from the first agreement. They are rubbish at doing repairs. I really don't want to move.

I'd hazard a guess that it is a periodic assured shorthold tenancy. Does the notice give a date that is the day before your rent would be due? If so then it is probably valid and following that the landlord can get a court order for eviction.

They've given you 2 months notice which is what they have to give if there are no other grounds. Had they wanted to evict you for rent arrears they could have given less notice.

If you really want to stay then talk to the agency and see what you can negotiate. Have a look at what other properties locally are renting for - you may find that rents have come down in your area, or that there are a large number of properties available indicating that the landlord would either have to lower the rent or possibly have an empty property. Get a letter from your bank to show that you had acted in good faith.

If you want your council to house you under their homelessness duty then you should not leave until the landlord has gone to court to get a possession order (which they will be automatically granted if they have followed the correct form of notice).

yes.

I can pay more, there are alot of properties but they all require credit checks, references etc. I'm not in arrears with them, I clean the carpets,etc so it's in pretty good condition for 6 years wear and tear. Our house is close to ds's new school which he moves to on Monday. I really don't have the energy to move but I don't see them feeling sorry for me. I've never had a rent increase so I could offer or do some work to the house to increase it's value. Bugger!!
