Breeder refused refund on returned puppy

My lovely idiot DP came home with a supposedly four month old rottie puppy (please no rottie comments!) on thursday - i was horrified to say the least (not because of the breed!) because im not ready for another dog. Anyway, DP really wants a dog of his own and desperately misses our old boys so i agreed we could keep him. BUT the dog was just not right, it was kennel reared and had clearly had no human contact, nor been in a house. It was nervous and as it turned out had aggression issues surrounding food - the breeder knew this but didn't pass on this information clearly to my DP. To be honest, i wouldnt have touched the dog with a barge pole in the first place but DP acted on the spur of the moment and we have had a dog from this breeder in the past.

The other dog we had from them was a star, he was 8 weeks old, came with its first vaccinations and 6 weeks insurance which is pretty much par for the course for a good breeder. This dog came with none of that. When DP took it back the woman said to him "oh yes, he was quite nervous" i mean, WTF - he explained that we had a three year old DD.

So anyway, when the dog tried to take my face off for defending my little jack russel i insisted it go back and DP agreed. Took him back, they offered a replacement but i have lost confidence in them - they have refused a refund. IVe not contacted them yet as i wanted to find out if i have any legal come back at all?? Spoke to a vet friend and he said kennel club will do nothing, even though pup was registered.

what contract did he sign?

both of ours clearly state that in the first instance the pups must be returned to the breeder, but that no refund will be given...

there was nothing on the contract that no refund would be given. There was a paragraph that said that if, after vet exam genetic conditions or illnesses were picked up then a refund would be given. That the pups must be returned to the breeder.

I do understand that you don't want to recieve puppies back after homing, but we had the dog for 1 day! and it become apparent very quickly that he was unsuitable (he would have gone straight back if they were open!)- I feel that my DP was mis-sold the puppy, as at no point did the woman mention his "dominance over other dogs" and "oh yes, he was very nervous when he was here!" - clearly not a dog suitable for a house with young children and another dog. I think my DP was partly to blame tbh as he never should have taken on a non homebred pup, its my golden rule actually.

Not too sure where you stand here but this breeder was clearly in the wrong if she knew that the dog had these issues and was going to a home with a young child.

Sorry - not much help to you now but, why oh why do people buy puppies on a whim without research into dog and/or breeder. Surely you visit the breeder and puppies at least twice before taking one home!!

Know this is not much help to you but it makes me so cross.

Hope you get your money back!

You have very little chance of getting your money back
You could try letting the breeder know that you will be very vocal about his selling a "dangerous" dog to you knowing that you have a child
Mention you have spoken to BBC Watchdog and local papers and they are very interested in making a story about it.

Problem is a potentially dangerous dog is still about then though isn't it

Otherwise I think you'll have to chalk it up and have him rehomed
Please be careful in the meanwhile

I agree with you totally newpup - he has gone back to the breeder now - i feel terrible, and DPs wallet feels worse!
