Can anyone help me? Someone who has done about 8K worth of work for my DP is refusing to provide a receipt - the problem is, we don't have any records so very difficult to prove that we paid him. My DP is a builder - do we have ANY comeback at all or do we have to swallow this? Its going to cost us nearly 2k

How did you pay him?

LucyEllensmummy · 18/01/2009 18:50

Cash - stupidly

Can't you take him to small claims court? If not, you can report him anonymously to HMRC?

LucyEllensmummy · 18/01/2009 18:57

The worry with that Tinker is that i think that DP did it all wrong and could even be breaking the law himself by paying him cash. I don't want to prompt an investigation of our accounts because things are very sketchy, no deliberate mistakes but i bet some mistakes anyway iyswim. I think we are just going to have to swallow it, but i hate the thought that this guy has basically fucked DP over for this much money and is probably laughing about it .

You can report someone not declaring takings anonymously so on that point you don't need to worry. Won't necessarliy help you though.

nancy75 · 18/01/2009 19:07

afaik its not ilegal to pay somebody in cash, its ilegal for them not to declare it

LucyEllensmummy · 18/01/2009 19:16

Tinker, i am vindictive enough to do that so i may well just do it, depending on what the accountant says!

Are there any accountants out there tonight who have any thoughts on this - other than i am obviously a klutz!

If you dont have an investigation, why do you actually need the receipt?

morningpaper · 18/01/2009 19:20

NO invoice?

LucyEllensmummy · 18/01/2009 19:23

MP i know, its stupid, i was busy having a breakdown and DP just about holding it together at the time - the guy told DP to make the invoice for him, but now refusing to pay - so its my fault as i should have done it, but didn't.

You will have to write it off I think

LucyEllensmummy · 18/01/2009 20:22

yeah, i reckon you are right there mp, unfortunately - a lesson learnt

How recently was the work done. Surely there is some sort of paper trail for the cash?

I suggest that you don't write this off as it will skew your profits for this year. Give the HMRC self-assessment helpline a ring and ask for advice. They can usually help.
