What is the position now wrt builders smoking while working in your home?

I guess my home does not count as public place (despite the comings and goings at the moment!) but it is a workplace atm owing to the fact that we are having an extension built.

Before the roof went on, I had no objections to the builders smoking. When they were indoors but in the extension, I was somewhat miffed when their smoke permeated through walls and doors into the main part of the house. But today, the wall between the main house and the extension was knocked down and now the whole of my house is slowly filling with the smell of cigarette smoke.

I am too much of a wuss to complain and tell them not to smoke, but I wondered what the legal position was since the smoking in workplaces ban came into effect.

I don't know but you should not be afraid to ask them to refrain from lighting up in your home.

Speak to the contractor / head builder, explain that now the roof is on etc, it is essentially in your house, so you are now requesting that they smoke outside.

Asking them to smoke outside in the garden is differnt fom complaining.

Just do it - they are builders, they won't be offended or upset, and they must get this all the time.

Whether they were workers or not, it's your house so surely you have the right to tell ask them not to smoke?

OK Massive Wuss Alert!!

I will ask dh to speak to them. I just don't feel able to say anything which is utterly contemptible I know, but that is the way it is. If nothing is said, the situation is going to get worse because they will soon be moving into the existing house and doing some alterations there.

I just thought there were rules about not smoking in the workplace?

I would have thought that their workplace at the moment is the address of your house. So normal rules apply - i.e. they can't do it. It's your private home, but it's their workplace.
