DH is manager and says you can take it back as it's a quality issue as long as you have proof of purchase.

BibiJesus · 07/12/2008 11:03

Er yes.

Today I am taking back 2 suction bowls that do not suction onto anything and a baby activity walker than after 2 weeks has stopped play music. Not entirely a bad thing but it's the principle

Is it a tesco brand folder? I'd take it back anyway although you wont get money you might well get an exchange.

My mother in law took a pair of shoes back to a shop 3 years after she bought them and the heel broke - got a refund . She basically stayed put until they refunded it, her principle was they were very expensive italian shoes and they should not have broken as they were only worn occasionally and well looked after. She is a very formidable woman though, I would have refunded her the money too!

jellyjelly · 07/12/2008 11:19

yes it still has the tesco lever arch file sticker on the side.

Jelly if its faulty you don't need a receipt, its not fit for purpose so its for the shop to prove you DIDN'T buy it there - and if its Tescos own brand they will have a job! You're entitled to a refund rather than an exhange. Im sure they will be fine about it Tescos are usually pretty good.

our cooker broke down after 18 months of absolute nightmares with it finlly we contacted cab who told us that under the 1975 act of whatever goods have to be fot for the purpose for which they are sold for 6 years .......we quoted this and got virtually all our money refunded and we kept the cooker(we freecycled it)- ive worked in debenhms and if you have a receipt you can take it back for the price you bought it at and if no receipt the last selling price,
ive taken allsorts back tights that ladder when putting them on .... hairstraighteners irons etc etc im fnatical i pay good money i expect good service!!! if im happy with product i tell them too i emailed dove cos their shampoo was fab they sent me a £5 voucher.

get those jeans returned and that file!!!!

ohhh dh has just reminded me we were in jjb getting ds3 new trainers the stitching was dodgy on the old ones i mentioned it to the manager who immediately offered me a new pair and even let me have the next size up!!!

More on Sale of Goods Act and 6-years thing here Goods have to be 'fit for the purpose', which doesn't necessarily mean they will last 6 years; it depends what the item is. So you wouldn't normally expect an item of clothing to last 6 years, but it should last for at least a few months/years depending on what it is. A large electrical appliance or item of furniture should last for years without breaking.

6 years is the 'limitation period', during which you have a right to complain about breach of contract.

jollyoldstnickschick · 16/12/2008 23:55

sorry mel you are right i was just excited

melpomene · 17/12/2008 00:02

Last year I got a refund on my dd's school shoes, when the strap broke after about a month of wear. (M & S, so expected better!)
