please help..I've just discovered I've got no MOT

...after I bumped into someone on a roundabout

The car is taxed and fully comp.insured, but on checking the paperwork, I discovered that I was supposed to have MOT it in Novemeber. I (genuinely) thought it was only due it's final service (the car is 3 years old)

I don't know what to do, I feel sick to my stomach as I would never knowingly allow this to happen.

What is going to happen??? What do I need to do? I informed the insurance after the accident, and at that point hadn't gone through my car docs. [panic sign]

Mmmm, mine is due on the 22nd Dec - 1st MOT, but I normally have my car serviced in the xmas holidays. Does this mean then we are not covered when it comes to accidents?

I expect your insurance will be invalidated by not having an MOT, but don't know how they'd know or if they'd bother to check it was MOT'd.

I think (and don't quote me, so look at the small print) that the insurance is invalid - at least that's what I always thought - you need all 3 to be legal to drive on the roads?

No MOT invalidates your insurance and so you are in a pickle were the police involved??

Sorry, but having no MOT at the time of the accident invalidates your insurance. I dont think they will make any exceptions for genuine errors.

Are you with AA/RAC? If so, you could get some free legal advice from them.

One way round it might be to pay personally for the damage done therefore not alerting any attention to the fact that you don't have a MOT. But could be expensive!

i don't see why they'd find out if you got one pronto. ask the mot people's advice they might backdate it (though that may be illegal)

Heres what to do fone the insurance company say you arent going thriugh with the insurance claim you want to deal with it yourself - fone the other people who you presumably bumped into and say you will pay privately.

If the insurance re involved they will need ll your docs .

I second sparkle's advice - dont even try to persuade a garage to backdate your MOT, it is illegal and you could end up in alot more trouble.

asked dp (works in car insurance) - he says it depends on the accident. If the accident was caused by the car not being roadworthy (i.e. wouldn't have passed MOT) then you will have a problem.

If it would have happened with or without the MOT being done they may well still cover you but check with your insurance company.

The car was definately roadworthy, and it was just stupidness on my part for not checking the documents sooner. Time just got away with me....still feel so awful.

This happened to a mate of mine. You were driving wihout a test certificate so will face points and a fine I am afraid.

You can try to mitigate the fine down( by post or in person)if they get you. Is the claim going through or are you doing without insurance - were the police involved?

Once you have advised your insurance that you do not wish to claim on your insurance they will be happy to inform the other mans insurance company that you are privately resolving this - lots of people settle their small accident claims bcos insurance premiums are so high they dont want to lose no claims and have higher premiums,it also means they keep your premiums with no paying out.

Worst case scenario id say is being prosecuted for no mot or insurance and a huge penalty and points.

speak to the mn and say if he will get a quote you will pay privately,assuming hes not likely to claim for whiplash and you are able to afford his repairs all should be well.

well if no police involved and therefore no requirement to produce your documents at the police station you may be ok. Unlikely the insurance company would ask for your mot certificate. Go and get one tomorrow and hope that you won't be asked for it. Don't try to backdate, that could only make matters worse.
