Is it legal for Vodapone to send out a mobile phone to you when you have not agreed to have one?

My dad was in the country for 6 months and had a contract with vodaphone for a mobile phone. He left on Friday and gave his one month notice in time to cancel the contract. He had confirmation of this. He received two texts from them in the days before he left saying what a wonderful customer he is and wouldn't he like an upgrade. He did NOT respond to these. The day before he left, he received a text saying that his "order" would be with him the next day. He assumed this was the refund cheque for the £100 deposit he paid. It was not. A new phone arrived the next day to my address (the address he was using while here) with a dispatch note which indicated he was on a direct debit contract.

Now, he has contacted the bank to make sure no money will be taken and he will be contacting Vodaphone next week. But how on earth is it legal for Vodaphone to sned a phone to him and set him up on a contract when he has not agreed or signed anything???

hiya, a similar thing happened to me a while back.
basically rang me "on behalf" of O2 to see if I knew I was due an upgrade.
I said I might like an upgrade, but could they ring me back at a more suitable time. they agreed.
never heard back from them but received a phone that I didn't want.

I contacted O2 and told them exactly what had happened and they put it all right for me.

your dad shouldn't have to pay anything. if he had a contract then it is normal to be offered a free upgrade each year that you stayt with them (or more frequently if you threaten to leave etc etc)
it, of course, is not legal for them to extend his contract without him agreeing to it.

I reckon, and the lady from O2 agreed, that sometimes these 3rd party companies make money from getting you to agree to an upgrade/extension to contract and put it all through anyway. they'll still get the money regardless of if you send the phone back

Interesting, but as far as I know the texts came direct from Vodaphone. And the phone itself certainly came from them. Very cheeky really and I am pissed off as I am left to deal with it all as he has now left the country.
