I have been working for nearly 2 months in a new job. I have been told that if I want to leave my current position then I will have to give 3 months notice.

I have found out that I am pregnant. About 6 weeks.

I will not be due any maternity pay from the company that I work for. What I want to know is. If I continue to work the company until I am 7 months pregnant and don't want to go back to work after the baby is born. Am I entitled to do this ? or will I have to give 3 months notice from that point.

Hi. Congratulations on the pregnancy.

Not entirely sure I understand your question but my understanding of maternity pay is that you're entitled to it if you are working with your employer when you are 25 weeks pregnant and have been working for them for 26 continuous weeks at that point. On that basis you might just qualify.

You have to give notice to your employer around 26 weeks I think that you intend to take maternity leave and your expected delivery date. Your employer would then have to assume you were going to take the full years maternity leave and you would only have to give notice of your intention not to return 3 months before that year was up.

Your hr department should be able to give you more info. Good luck

You might be entitled to SMP, just, but won't know for sure until your due date is confirmed.

In terms of maternity leave, regardless of whether you're entitled to SMP, you are entitled to a year maternity leave.

If you don't want to return to work afterwards, you need to give your normal notice period. So you would need to hand in your notice 3 months before your year maternity leave is up.
