the couNcil has a tree outside my dead mothers house - a huge thing which clearly wrecked the frot garden wlal with its roots, i starte d to persue it with the council who said that they wated me to get a couple of quotes - they ever accepted liability but they did take the tree down.

i never took it any further becuase i like to pretend that all the shit to do with my dead mother does't exist this emu shit works well for me i the short term.... ayway, so the house isn't selling and i decided i must chase this wall thing

the council said that they closed it - so i said reopen it, and i am in talks with their solicitors.

the solicitor attached a copy of a letter dated july this year, which i swear to god i didn't recieve.

it said that they wanted me to have tests done to prove it was their roots that caused the damage

ow i think they are taking the piss ad i wat a solicitor

but i can't afford to pay up front

any suggestions?

Pretty standard for them to want proof that the tree did the damage - price up the quotes and take it from there.

I dont think a no win no fee would be any good, they tend to be for accidents etc where compensation is paid - you are only after repairs being done.

happymummyofone is right, solicitors only do no win no fee for personal injury cases. Sorry.
why don't you try talking to some landscape gardeners about the work required to put the front garden right. If they think you will go ahead and get the work done through them they might put something in writing about what may have caused it. Worth a go and wouldn't cost anything.

I think you would need to get a report done by an aboriculturalist, this is someone who knows a thing or two about trees. I would think they would be able to prove what the roots are that have caused the damage and see if this matches up with the offending tree, (if you know what it was - maybe you can find a photo of it). Why don't you find out how much one would charge for this sort of report, it might be cheaper than a huge level bill, if it is not already too late?
