Does anyone know anything about tenancy law?

I live in a basement flat

The people above me have wooden floors with no rugs or carpets at all. The noise is terrible.

Is there some kind of law that states they should have carpets laid?

Upstairs neighbours are my landlords by the way.

Suspect with recession they might find it harder to find tenants and therefore may be more prepared to do something about it when it affects their income and tenants are not staying.

Not sure on all the legal ins and outs but would noise pollution regs apply in this case? I think you can get someone in to record how loud the noise is.

Yes, the landlords are nice people, friends of yours, but you're looking for legal advice and trying to sic the council on them for wooden floors when you're moving out.

I am not setting the council on them on the contrary as I have said several times I spoke to the council to get some advice.

FWIW I'm an old-timer too and that's got sod all to do with this. Are you trying to say that old-timers are generally more rude because that is not my experience of MN thankfully- hence almost 6 years on I am still here

I don't see why you are getting so wound up over this, Shiny. It's getting so ridiculous it's funny.

But seriously, if you've been there that long it's amazing that you're so incredibly riled by a few comments. GET A GRIP!

If you find it unpleasant, well, that's your lookout.

You are asking for legalities and how to legally force your so-called friends to lay down carpet in their own home that you are no longer going to be living under and then conclude that anyone who points out that's deceitful or weird or a mean-spirited is a cow and unpleasant and you're talking about them in the play yard email.

For starters you are the only person on this thread who have used the words deceitful. Nobody else has accused me of that.

Secondly- and how many times do I need to say it...I am NOT forcing them to do anything. I simply wanted to see what legalities (if any) there were/are so that I could speak to them about it further and use that as the basis of a further conversation.

What you maybe haven't understood is that there is no dispute- I am not going behind their backs. I have in fact just got back from having lunch with them AND their new tenant and they are now looking into what they can do to reduce the noise- I stayed upstairs with their youngest son whilst they sat in my flat listening to him with his skipping rope- THAT was enough to convince them.

They know I have spoken to the council and that they are calling me back tomorrow. They await their comments with interest and are happy for them to come round and monitor/measure the noise.

GentleGarotter- they were very interested in the product you listed earlier and are going to look into it. Thanks again for that.

It is tricky balancing a friendship with legal obligations. I am just keen that they manage to keep tenants for longer and having failed in my initial chats with them wanted to be able to say 'Look guys acording to the housing act blah blah blah you are obliged to do XYZ'. That and that alone was my reason for starting this thread.

And why I am I bothered by your tone? Because deep down I am a pacifist and I like to get along with people, that's why

Like I said: don't know how the law stands in Scotland but down here, after 6 months, an assured shorthold tenancy is ongoing and can only be ended by the landlord under very specific grounds. Trying to evict your tenant in order to obstruct them from exercising their legal rights is not one of them so I'm glad you're not my landlord either

Good news they're being receptive to you now the council are involved Shiny - good luck
