Can anyone advise on when someone doesn't leave a will?

It seems horrible to be even thinking about financial stuff right now but my mum is driving herself crazy trying to sort out paperwork after my lovely dad died last week .

Basically most of his bank accounts are in a joint name with my mum. But my dad has a few in his own name and if my brother who is disabled automatically gets some money from Dad's single account ( which he could as no will) then he could lose his benefits.

Is there anyway mum can transfer it into her name as she is next of kin? There are national savings certificates of £10k and an ISA.

Any advice at all would be much appreciated.

surely your mum will get everything as next of kin as your dad died intestate? so sorry for your loss, please see a lawyer though.

As your mum is next of kin, then it is my understanding that she has legal rights to your dads estate, not your brother. So she should choose what to do with it. I'm not 100% with that mind, so i hope that someone who knows for sure will be along to advise you.

I'm sorry for your loss and hope that your mum doesn't get too worked up.

How much was the estate?

Your mother will get the first (up to) £125,000 plus any personal possessions.

Anything remaining is divided into two:-

  • Half to you and your brother now
  • Half in trust during your mother's lifetime (so she gets the income) then divided between you and your brother on her death.
