I have breached (probably) my tenancy agreement; what could happen?

Ok to cut a long story short I have pi$$ed of the company I am letting my flat from (wholly justifiable reason for me to have pissed them off and they were in the wrong as far as my partner and I are concerned).

In retaliation (or so it seems) to making then cross we are having our flat inspected on Friday. Now I know we aren't supposed to have put up pictures etc on the walls but we have; we have 4 up all together (2 nails were already in wall as noted in inventory, we put 2 more up). We have also out up some small shelves (4 drilled holes).

Now I don't need a lecture about "damaging" landlords property (we are quite prepared to leave shelves up if landlord wants or we can take them out and fill the holes) and we know full well that if the landlord wants he can charge us for the "damage", that's all cool.

I am just wondering more about the fact that if they say we have breached the tenancy agreement (it explicitly states not to put stuff on walls etc) can they just kick us out? Or do they still have to give notice is usual way?

That's exactly what we are worried about tilly and know the only way she could "get us" would be the shelves and pictures. Good to know we would always have to be given at least 2 months notice though, thanks for that tip! . We're a lot less worried now. Let her come I say

shinypinkshoes we also asked, we called the letting agents who said write to us do not disturb the landlord; so we did and they didn't respond. We only tried the once and thought bugger it we can sort it out when we leave and we are also happy to leave the shelves there (would benefit future tenants IMO)

flamesparrow thanks for that I did wonder what Bree meant! The landlord said that my DP must be very clever to have silence the alarm and did he want a job as his handyman (he was just joking I think). He is really nice guy and has quite a few different houses.

The 2 month rolling contract is pretty standard, we have been in our place 2 years and have been switched onto one recently, I suspect it is something to do with the recent rules about deposits and whatnot, a way for landlords to get around new rules. You have to give 1 month when moving out, they give you 2 months.

I'm a landlord (lady?) and when our tenants move out the agency charge us a fee to get new ones.
If your landlord is happy with, you are looking after his property then there is no way he will agree to the agency kicking you out and finding new tenants just because this lady has taken a dislike to you!!

I'd write to your landlord. Explain the full situation including that you believe the inspection has been arranged through annoyance.
Tell him you are happy to go through with it to prove you are keeping the place nicely (detail the improvements you have made) but you would appreciate it if he could ask the agency to stop bothering you after that.
Ask him to tell them they must give you the alarm code and window keys too - after all thats what he pays them to do!!

Rolling contracts after 6 mths have been standard practice for a lot longer than the tenanacy deposit scheme and, yes, they still have to give you 2 mths notice.

If agent does give you grief I'd contact the landlord again to let him know. If I was in his position I'd much rather have good tenants who were not being hassled by agent. Rubbish agent is why I manage my own flat now.

yes it has, feetheart, I meant that the deposit regulations now in place are not necessary with a rolling contract. I was just giving an explanation as to why they might have gone on a rolling contract, as when we went onto one after 2 years I was petrified it was because they wanted to kick us out!

We've only ever had yearly contracts (student days!) so not used to this rolling malarky. I think we're just going to let her come and then if she bothers us after that then I will write to LL. He is quite elderly so could probably be doing without the stress and at the end of the day if we do somehow get kicked out we aren't that bothered esp as we would have 2 months notice! Only the 2 of us grown ups to worry about (I am not a mum) and loads of family and friends to help us out. As I said I'd rather a good relationship with the LL/Agent over anything else. But I doubt it will come to that!
