Decree Absolute????

Just a really simple question, wondered if anyone can answer?

DP has had his decree nisi through this week, and has worked out that he can apply for the absolute at the end of September, so far so good.

So, if he goes into the court office with the application form and fee, when can he receive the D37 decree absolute through?

So long as six weeks and one day have passed since the decree nisi, the court staff are obliged by law to make the decree absolute on the day they receive the application.

If your dp is going in to the court office, he can ask them to do it there and then, but it will be done by the end of the day anyway.

This only applies if he's the petitioner, if he's Respondent, he has to wait for his wife to apply. If she doesn't do it promptly, he can apply three calendar months after the six weeks & a day.
