The Littlewoods group demonstrate rather, erm, liberal interpretation of contract law. I would advise ccing your local Trading Standards into correspondence, and backing up emails with snailmail.

have emailed and said i expect an answer in 24 hours. will keep copies, contact Consumer Direct etc and follow up.

does anyone know how much phonecalls to their number would cost? tis an 0844 number.

My "bed" isn't due to be delivered til August, but the money is already out of my bank. I think I will wait to see how to get the best response from them!

basically then everyone needs to accept delivery of the drawer and then ring to ask where the rest is. if they refuse the drawer then there will be no contract cos delivery of the goods will not have taken place.

ok, have contacted consumer direct and composed a suitably shitty polite letter...am asking for a response (ie my bed!) within 7 days.

will quite literally keep you posted!

many thanks for the help offered here, espcially avenanap tbh i was ready to give up but am off fighting again!

CD advice was that we could try quoting Sale of Goods Act 1979 - goods must be as described.

this will depend on what your invoice actually said ie bed or drawer.

thing i am attempting to bust them on (on advice of CD)- their terms and conditions say that customers will be contacted prior to delivery if there is an error in the order - no-one contacted me.

if they can't stick to their own terms and conditions thn why should they expect us to?

plus their definition of a contract is very shady...

I think it's pretty well-established that a website, like a shop shelf price, is an invitation to tender rather than an offer. So your order isn't an acceptance of an offer, and there is no contract at that point.

Your contract is accepted once the order has been dispatched to you. You are free to cancel up to this point and get your money back. After this point it gets more complicated, you can send it back with the delivery driver or if you send it back at another time then you have to pay the postage. The time limits to return goods are different, you can not return anything perishable or that has been custom made.

mutt - agree that actually getting the bed is not the issue any more - am just trying to make the point that they are not above the law and should give more thought to their customer service and consumer care!
