My brother's landlord has not paid council tax for over 2 yrs and owes several grand. My brother and his housemates have been given an eviction notice by the council to vacate NEXT WEEK. Is this legal? What can he do? Anything?

OK sorry bout that. I'm a Brit in the US, my brother is a Brit in Cambridge. It turns out the landlord has told the council the tenants are all students and that it is a student house.

This is not true, as 2 of the 4 current tenants are full time workers. The landlord gets rent each month from each tenant that as far as brother and housemates knew, covered all relevant taxes. No leases were signed (stupid brother) and no one knows where the landlord is as he's done a runner. Thus the council are getting a possession order from the court and have written requesting vacation of property within 14 days. No court order has yet been received.

Brother is moving out this weekend and now he knows how dodgy the landlord is, wants NOTHING to do with the situation.

Does the council have your brother's details?
Don't be surprised if they come after him for the Ctax
If it is a shared house he could get stung for the whole lot

That's what I told him. He lived there 6 months with no lease. I told him to see the CAB about offering the council HIS share of the CT for the 6 months he was there, and also to give the names of the other tenants as no doubt they will dob him in anyway.

with evictions tenants have no rights I'm afraid

so if your house is repossessed even if you've been paying your rent you're evicted

it is a good idea he leaves

TheBlonde · 03/07/2008 17:40

if he offers to pay and the other tenants disappear he will get stuck paying the whole lot

I just found out one of the other tenants (who had all utility bills in her name) has got a solicitor already on the case, so I would think as she has admitted all links to the property etc and has lived there over a year, SHE would be the first in line in the hierarchy of liability? I told him to wait it out and talk to the CAB on Monday. But he is definitely moving out this weekend.

Aren't you all each equally liable for all the council tax IYSWIM
