paternity leave question

DH is applying for paternity leave when DD2 is born. On the form, it asks for the due date, and the date when he wants the leave to start. It tells us that he can change that date, but only if he gives 28 days notice. We would like him to start the leave when I give birth, but obviously he isn't going to get 28 days notice of that! Am I going bonkers, or will he technically have to take the leave from my due date? I can't imagine that fathers of 38 week term babies leave their partner to cope alone for the first two weeks, or those of 42 week babies twiddle their thumbs at home and then go back as the baby is born.

Formally it's 28 days notice, but I don't think the company would really expect that - if you give the due date, but your DH talks to them and says I would like to take it from the day the baby is born then it should be ok - as long as they have a rough idea. Or he could book holiday also, or take emergency leave or parental leave (one weeks blocks for that though, not sure about notice).

So it is 28 days notice. I think that DH's boss will be sympathetic to shorter notice. I hope so! DH's job is quite flexible by it's very nature, and he wouldn't need to be specifically covered. No-one else in the company could do his work for him anyway - they wouldn't know how.

Pretty sure it is - well, to apply in the first place not really sure about notice to change it. But then technically you have to give alot of notice usually for holidays, but DH used to give a few days notice (if it was OK for them) etc.

He can specify the baby's actual birth date as the date he wants leave to start (i.e just put 'baby's date of birth' on the form) then would only need to give notice if he wants to change that to a different date

Really? That wasn't an option on the forms that he had. It was definitely a DD/MM/YYYY thing that he had to fill in. Surely everyone would want the actual birth date as the start of PL?

It is daft unless you are having a section where you can give an actual due date. We put on the form our EDD but also put in red writing after it "once the baby is born".

DH has agreed with work that this is ok and he intends taking his PL when I am released from hospital.
