Mystery CCJ help

My husband checked his credit report via our banking app this morning. It showed a CCJ registered this August for over £8k!!

the CCJ is registered under our old address which we moved out of 18 months ago and as far as I’m aware have moved everything across.

the court shows as county court online but no contact details.

How do we find out information about this CCJ? I don’t have a clue what it’s about as we’ve had no letters or correspondence and can’t for the lie of me think what it could be about.

Please help

We once had one likes this for 4.5k registered to an address we hadn’t been at for 14 months - in our case it was my sons old state boarding school charging us an extra term as we gave 1 week less than a full term , but they didn’t instigate it for 6 months and in the meantime we had moved and only had a 6 month redirect on , so never saw it, never had chance to even object or pay off- was a total pain in the arse for years , even though we settled it off

You can look on the register of judgments for the details for a small fee, apparently

Unfortunately we’ve tried this already. It only shows us the case number and date but not the claimant. I saw online to contact the court direct but it shows as county court online. Thanks anyway

It’s so frustrating that this can happen! Sorry to hear about your situation. Once we find out who it’s from, I think we are going to apply to get it set aside as we haven’t had the opportunity to respond to any paperwork. Thanks for your input.

if you’ve got the case number your husband can contact them (use the link posted by Sleaford to find their details) and ask who the creditor is. If they’ve sent a claim to an old address you could apply to have it set aside. Get debt advice from Citizens Advice Debt Helpline 0800 240 4420

Thank you so much for this! He’s going to phone at 9 and once we know what it’s in relation to, we will apply to have it set aside in view of no court papers. Thank you for your help!

There should be a specific email address for applications in the link I posted earlier @Daisychain789. The form youll need is an N244. Please do read the guidance notes before filing in the form.

The fee is £313. If he is on benefits or a low income he can apply for help with that fee

Make an application to a court (application notice): Form N244

Use the N244 form to ask a court to set aside or vary a judgment, or suspend an enforcement process. Evidence of identity and declaration form (CH60) also included on this page.

We did do the apply - that was a process in itself, ! However because we couldn’t pay it all off in one go ( offered 3 payments) - it had to stand unfortunately - if it’s legit and technically due then my experience is only go down that route if you can 100% pay off immediately.

So we’ve got to the bottom of it… it’s an individual claiming about a car accident 3 years ago… we bumped into the back of someone turning left into a drive when they didn’t indicate. There was no damage to either vehicle and no-one was injured. We gave driving license, insurance details, our number etc and heard no more… and now they are claiming the amount above!

Weve applied to set it aside in view of no documents received etc and will wait to see the documents when they re-apply!

I don’t think that the OP’s DH informed his insurance at the time though? Would he still need to inform his insurer?

Even if there's no claim I'd be letting an insurer know as I believe that's what the insurer will require.

If the other party ended up making a claim then I'd have thought the OP may need the insurers services to fight it, particularly if there's a suspicion that the claimed injury (whiplash?) is spurious. OP has no knowledge of the claim until the CCJ came out of the woodwork.

The lady was lovely and said it happened all the time as the turn onto there drive was dangerous..

We assumed if any issue with vehicle or to herself we would be notified as she had all our details and insurance details.

We had a lot going on at the time with a disabled baby so didn’t think to notify insurance as no damage also we’ve never had any accidents or anything before and didn’t really know the process but we shared all our insurance details…

I will do thank you! We’ve applied to get it set aside for now as still don’t have any of the paperwork. And hopefully this will give us some time so we can figure this out. It just seems crazy to pursue this now after 3 years, when we weren’t trying to evade responsibility

I would definitely contact your car insurer now and let them know what’s happened. It probably happens a lot, but surely to make a claim, they would have to go through insurers, even for a personal injury claim.

Surely the OPs current car insurers won’t be interested and the insurer they had at the time of the accident won’t be interested as they weren’t contacted at the time ( I’m assuming OP has changed insurer )

We’re with the same insurer. I will let them know today.

i was just naive to not contact previously, i just assumed as no damage and as we shared our details including insurance that was sufficient.
