So I am going to have to be a bit vague as this is quite a specific enquiry.
I am employed by a medium sized, private business, where all employees have to be registered to a larger organisation, with an accompanying payment. The business pays for this and if it is not paid, the employee cannot work. We have just found out that this payment has been included in our Benefits in Kind/ taxable benefits and we have all been taxed on this. I have looked online and this payment is exempt from a BIK as it meets HMRC’s strict criteria. It should not be listed as a taxable benefit and we shouldn’t be paying tax on it.
However, despite this information being readily available- our employer is disagreeing. They are saying it IS a BIK and therefore cannot be removed from our tax codes. The actual amounts aren’t huge, however, for longer standing employees, it’s a good couple of thousand pounds over the course of their employment that they shouldn’t have paid.
Is there anything that can be done about this if the employer won’t back down?
