Drink Driving - just on the limit, if went 2 court what would happen?

I need some advice on this.........

My friend has found out he husband borrowed some money from someone, when she found out she asked him what it was for and he said to pay a fine. He said 2 years ago he got caught/pulled over for drink driving. It went to court and as he was "just on the limit" as he put it and he pleaded he had a job and a new baby etc... he was let off with a £2,000 fine but no points? He didnt tell her as they'd not long had a baby etc...

Do you think this is true? Even if on the line, do you think he would of got let off with just a fine and no points?

no experience, but it sounds like absolute bullshit to me. Could he have a gambling problem?

Well, I'm sitting here looking at the highway code and according to that it's not true.

It's says here it's an automatic ban for drink driving.

It is extremely rate to go to court and not get disqualified for drink-driving, whatever the reading.

Even if the mags chose not to disqualify, the offender would still get 10 points which remain on the licence for 10 years.

it says 'if exceptionally not disqualified' then 3-11 points.

Doubt he tells the truth.
He would have a real problem getting car insurance, as he will have to admit to any traffic offences.

He may also be driving about whilst disqualified.

The code says the maximum fine is £5,000.

So he could have been fined AND disqualified.

But at the minimum he's got points for sure.

this is what I think, but she says he is adament that its true. She has checked his Lic and no points on the paperone that you have to send away.

Is there anyway she could check this out?

Drink driving is shit. I think anyone who gets caught doing that should be banned for life, fined £5,000 and put in jail for 6 months - new job, baby, whatever.

he's lying. automatic ban for drink driving. Could he have been driving anyway without a licence? it happens.

If the £2000 fine was for drink driving then he must have been seriously over the limit. I worked with someone who got a £2000 fine for drink driving but she was seriously over the limit, she was also banned from driving for three years.

Ive just asked her and he said that he was just on the line not over etc... but court and fine only as he pleaded for them not to ban him.

How can she find out what he did do? Is anyone able to get court information

Can't she check the records somehow? Arent they public?

I never heard of anyone being able to plead circumstances and get off a drink driving charge - its an automatic ban.

If he was at 35 and not over, then why did he have to go to court and get a fine, anyhow?

He wouldn't have had to go and plead with them not to ban him then, I would have thought.

And that's a pretty steep fine.

The chap on Traffic Cops the other night was at 96/100 and he was fined that amount.

And banned, too.

Code reads, 'In the case of serious offenses, such as dangerous driving or drink-driving, the court MUST order disqualification. The minimum period is 12 months . . . '

And I would think he'd have points assessed as well, lapin, no?

That's a really steep fine considering he was driving whilst impaired on not over the legal limit of 35 microgrammes/100 millilitres - assuming he was breath tested.

I stole it out of the Highway Code, lapin .

DH still has all his copies from when he had to pass the minibus test.
