UC and property

i fled the family home due to domestic abuse and I’m now renting and claiming UC. The family home is for sale but not sold yet.

does anyone know if the equity in the home and the 6 month disregard counts from day one of the claim (even though it’s not sold yet), or is it only from when the equity funds are received?

UC are aware of the property and that it’s for sale

Well done for escaping. I would hope it wouldn't be till it was sold. But ask this in the journal.

It doesn't count until you get the money. And the DWP can extend the disregard period if you're using the money to buy another home but it hasn't completed.

UC Regulations Schedule 10 para 5 allows a 6 month disregard when the claimant left the premises following estrangement.

There is also six months where you're taking steps to dispose of premises. That can be extended.

Assuming the steps to dispose of the property are genuine extension should be straightforward.

Thank you for your replies. UC have advised I need to complete a form to confirm I have capital and for them to assess it by a decision maker for it to be disregarded. Obviously the money is totally tied up in the house currently as it hasn’t even sold yet. Will I still be paid as normal whilst this is being looked at?

I think they're usually pretty quick at dealing with capital disregards that, as seems the case here, clearly fall within the rules. If you're in the disregard period for an estranged couple or the property is genuinely and properly marketed for sale you should be fine.

When it gets more difficult is where a proper market value needs to be ascribed and for reasons x,y or z it's not able to be marketed with vacant possession. Examples might be where there are occupiers who cannot easily be moved or significant disrepair.

My assessment period runs up to 18th and I get paid on 25th. I will post it back the same day as I receive it. I left the home due to domestic abuse and it’s been in the market since before I left but sadly not sold yet!

They’ve updated my journal today to say my payments will be stopped until this is sorted. I won’t be able to pay my rent or bills
