Maternity Pay

Hi,
I am currently pregnant & trying to be proactive in thinking ahead about our finances..
My company only offers SMP maternity pay... However I found out that the company offers Full pay for 2 weeks for paternity pay. It feels wrong that even though it's 2 weeks full pay, women only get Statutory pay. My question is, is it worth getting a solicitor involved in this situation or is it legal?

SMP is 90% of your earnings for the first 6 weeks, before dropping to the statutory figure - surely that’s better than only 2 weeks full pay?

I am very rusty as I’m retired HR but I recollect a case where a male employee went to ET because their employers Shared Parental Pay was statutory only but their maternity pay had an element of occupational. They lost.

Additional paternity leave can be paid to both sexes I.e. same sex relationships whereas maternity pay can only be paid to women.

Unless there have been more recent cases I suspect this is legal. Sorry.

it’s legal but worth asking your HR team why paternity is above statutory minimum whereas maternity isn’t…

Thank you everyone for your replies.. I just thought it was unfair to be paid full pay for men even its for 2 weeks & not get anything extra apart from SMP pay....
