Iva and mortgage can I give up my share first

My dh and I own a home, which is very affordable and he could get the mortgage on his own. I have substantial credit card and personal loan debt. Previously attempts to consolidate have failed and although I'm meeting minimum payments my debt is rising. Im considering entering into an IVA. I have had a debt management plan around 20 years ago and successfully completed it but life events haven't quite gone to plan. Please no judgement.
Would there be anything legally stopping my husband buying me out of the mortgage and then I enter into an iva for my debt?

Have you had advice on this yet OP? Are you absolutely sure an IVA is the best option? Can you actually even afford an IVA, as the fees are really quite high?

You can enter into an IVA while on the mortgage, however your home and the equity will be assessed, your IVA could well impact your home. You can’t just ditch assets (e.g. being taken off the mortgage) to then enter an IVA, no.

Another solution is a remortgage and release fund which would clear debt. Were talking over £35k cc and loans in debt and we have a small mortgage currently with 90k equity?
