ANY ADVICE? Someones used my sisters card (somehow?!) and bank won't do anything ...

She ALWAYS keeps her card with her and she NEVER uses it, when her money goes in, every Tuesday we walk to the bank and she withdraws it all from the counter inside the bank.

She got a letter saying someone had used the card in a shop (she hasn't got a clue what the shop is) and by doing so shes gone overdrawn.

So they gave her an emergency overdraft which costs xxx amount + other charges blah, blah, blah

which adds up to £90 whichh will be taken out 1st July.

She hasn't GOT £90! And it wasn't her.

But they say theres nothing they can do.

They must think if it was a fraudster then the amount would have been bigger but considering she lives on £60 a week and she had already withdrawn her money the fraud obviously couldn't use the card to run up a massive bill but did cause her to go over.

Shes still got her card so unsure how its happened.

The bank are addament she has to pay £90.

i wld say go to CAB, this doesnt sound supportive banking ti me they should at least check the locality and validity of the shop

In our case we had a problem with our credit card, we phoned the bank they immediately closed the account, reimbursed the money that went out and asked us to sign an affidavit to state that we did not make the transactions, end off. They handed the case over to the police who dealt with it. So I think she needs to see her bank face to face!

where is the shop that the card was used in?

if it was an unsual transaction not even in the town where she lives then the bank should be on notice

i would go to the bank on tuesday and discuss face to face

speak to CAB if necessary as BB has said

I agree. Go to the bank and have it out with them then change your bank!

point out to the bank that they need to follow the banking code or you'll refer it to the banking ombudsman...

para 12.12 "If someone else uses your card details without your permission, and your card has not been lost or stolen, you will not have
to pay anything."
