Tax free childcare account - can ex DP have one?

I split with my partner a few months ago. We have 2 DC aged 4 and 2. I’m a high earner and not eligible for a tax free childcare account (we’re in Scotland - I think that’s relevant).

Things are still tricky between us as we untangle our lives, he’s not made things easy at all - but the topic of child maintenance will need covering soon. I was wondering if there’s any issue with him opening a government childcare account to take advantage of the top ups, as his income makes him eligible. It’s also something he’d find infinitely preferable to feeling that he was giving money to me each month 🙄.

I may be overlooking some obvious issues, but having never used the scheme before I’ve no idea if this is allowed and don’t want to suggest it to him without finding out a bit more first.

The children live with me, the child benefit claim is in my name but I’ve opted out of receiving payments - would this have any impact on his ability to set up an account?

Thank you for any help, it’s been a lonely place trying to navigate this and I genuinely appreciate help.

Have a look at the “if you are separated” section right at the bottom of the page. It suggests the “responsible” parent is the one who gets the account. In cases where that is unclear, you both apply and HMRC decides.

Child benefit isn’t applicable here and has no impact. I would suggest the fact the children live with you means your ex won’t be able to open an account.
