Any police officers / insurers / lawyers out there who could advise about this non-accident?

Please see thread here

Basically, a motorcyclist says I hit him this morning. Even if I did I would still think it was his fault. He and his buddy were very agressive towards me. There is absolutely no damage to me, him, his bike, or my car.

My questions is...

Should I report the incident?
Should I report them for harrrassment?
Do you think he will really get my details from my registration?

I don't really want the insurance company to find out about it and raise my premiums for a an accident that could very well have never happened.

He says I hit him. If I did (and I acknowledge there is a possibility) if was so lightly that one whould notice it on a bike but not in the car. This is possible. I'm sure a very light tap might be noticed on a bik but absorbed by the car so that the drived wouldn't notice it.

But, when you go weaving through traffic where there is clearly not enough room for you, surely it is your fault.

Anyway, opinions please....

Is this all about your highway code thread of yesterday?

AtheneNoctua · 14/05/2008 14:57

sort of, although that thread was also from today.

I wondered what that was all about....
Can't advise you I'm afraid, have no idea.

AtheneNoctua · 14/05/2008 15:02

I was trying just to gather facts about whether it really was legal to weve through cars without telling the whole story and hence clouding judgement with a a lot of irrelevant details.

Sorry for the confusing multiple posting.

No one was, hurt nothing was damaged. What exactly is the case they think they have against you?

dizzydixies · 14/05/2008 15:22

AtheneNoctua

all accidents involving injury to persons, certain animals, property are reportable to the police

those involving two vehs/parties who are happy enough to resolve between themselves are non reportable

if there is a disupte over blame then police can be involved at request of an involved party

am confused as to what he is going to report you for, there was no damamge to him/his bike/your veh?

what exactly is he wanting from you?

if there is damage to his veh and he reports it to his insurance, then his insurance will have to contact the police and PAY to have your details released to them to follow it up - but he hasn't reported it or you would've spoken to a police officer

If I were you I would either phone your insurance company for advice or attend at your local police station for advice

it may be a case that they'll tell you they'll do nothing as the bikers haven't reported it or they may take a note of it, they may also take a note of the bikers being unpleasant but can I ask were you on your own? there were unfortunately 2 of them which doesn't help

this is a hard one as you're not sure of their intentions

AtheneNoctua · 14/05/2008 15:31

I too am inclined to think he won't report because as you point out, what exactly is he reporting.

He said he was going to report me for:
1- running into him (which he'll have a hard time proving since there is no damage and I still am not convinced even happend)
2- leaving the scene of the crime (which he will have a hard time proving since I have a picture of his parked bike and I had to park and get out to take that picture).

Ok, I think I shall chill out. The irony is that it just confirms every preconceived notion I already had of arrogant bikers who think they can bully people in submission.

They way they treated me was definately somewhere between rude and harrassment. But, I couldn't prove it, and frankly I'd rather just move on.

But I will say this. It makes me really mad that they go round and gang up on motorists and get away with it. I don't think the two guys knew each other. I think it was just some kind of "professional" courtesty where one stopped to provide backup for the other. And to be fair, it was the one who was not involved in the accident who was more agressive.

It may be worth reporting it too the police to ensure that they are aware of it.

Can I ask, how did they say you hit the bike (I've been hit by a car from behind, only knocked the back wheel, but it is v. annoying).

Your details can not be released to individuals without your approval.

Second the suggestion that you should report the whole episode to the police.

chocchild · 15/05/2008 12:10

Definitely report this to the police so that the incident is logged just in case you may come to rely on it later on. I personally think he is just trying to bully you so hopefully you won't need it but report it anyway.

write everything down now so you have it by you just in case. Include time, date, place, direction of travel, weather conditions, who said what, who did what, where you pulled over, whether you were stationary or moving, how fast, whether handbrake on, when you first spotted the bike, etc. Then just keep it in case you need it.
