Will be entitled to UC with 50/50 care ?

Me and ex have a baby under 1 & are splitting up. He wants 50/50 care, I don’t think that’s suitable due to baby’s age but he’s a good dad so I guess I have to agree.
he has his own mortgage and has enough space and works full time and earns a high salary.
i moved Into his house after she was born but will be moving out soon I’m trying to find a new house. I currently get child benefits for our baby and not long ago used to get UC for my older child who is 6.
im just wondering will I get housing element kf UC if we share 50-50 shared care?

You still have to decide which one of you is the 'main carer' even if you have the same amount of care time. If it's disputeed they will decide based on who gets child benefit, who makes and attends Dr appointments, who corresponds with nursery or goes to meetings, and who's address will be used for school application etc. Though realistically, they will only look into it if you both try to claim for the same child, so if he's on a good wage and doesn't need uc, I don't see why he would object to you been the classed as main carer.

Pretty much what @Sprogonthetyne says.

To my mind this stuff is only a real issue if you're both on UC. From what you say about his salary etc he's probably not entitled.

DWP's regs are binary; you're the carer or the Dad is.

My advice would be to add your child to your UC.

Would Dad have a problem with that?

@BromptotooWhen she was born we temporarily split up so she was on it then for a little while then we moved into his home.

If you have your 6yo full time and the under one 50/50 then you can claim child element for them. Housing costs will be available too based on you being seen as needing two bedrooms.
