Just wondering if anyone has any experience in dealing with Financial investigation through the CSA? My ex partner has decided to retire early at 56 and before then had an income of over 170k PA, although he underpaid me ( not by loads ) he did pay every month, he's now refusing to pay anything towards our child, I have our child 90% of the time, I know for a fact he has a sizeable pension, assets and investments etc. He's managed to convince the CSA he has zero income. He's refusing to even help with our child's clothing/clubs etc unless I drop the case, if I drop the case he will pay me a tiny bit that he's 'worked out' not sure how he's worked it out with a zero income ?! I've been rejected 3 times with CSA and numerous variation forms etc. Now it's apparently been passed onto FI but unsure how long or if they'll actually be able to help as I don't have a scrap of evidence ( although he's taking flying lessons?!) has anyone any experience?

AFAIK, the CMS can assess his payments on any regular monthly pension payments her receives. Any lump sum he takes out is not considered. So if he’s taken out a lump to live on, and isn’t being paid a monthly amount, he’ll be assessed as nil contributions.

Avoiding paying CM should really be treat as seriously as tax evasion.

He's declaring no pension too although I know it's very substantial! Hopefully the FI will help because the CSA have take 6months of rejectioning me and I'm no further forward.

If he’s taking a pension he won’t be able to declare no pension, as it’ll be reported to HMRC like a salary and so they’ll know it’s getting paid. But as PP said if he’s just had a lump sum that he’s living off with no regular payments then no CM would be due

Yes, I went through this about 10 years ago. ExH had convinced CSA that he earned £34,500, when he actually earned £134,500. They were useless and I didn't get anywhere at all, sadly. They even had on record (from HMRC) that he earned £134,500 in 2014, but believed that without any change in jobs that he now magically earned so much less. The kids are adults now. I think he owes me circa £20k which I'll never see. DD just got married and I paid for half. He paid nothing, despite being really well off. I wouldn't piss on him if he was on fire tbh. Sorry, not helpful, I know. These men are scumbags.

The problem I had though, was that the CSA and the investigators refused to access the HMRC database. Fuck knows why.

It's so annoying, he's completely trying to keep control, I would make him have my son more to even things out but I'd rather not have him anywhere near if I can help it, it's ridiculous x
