How do you find out if an Act (Childcare Act 2006) has been altered/amended/fiddled with?

Think you can just google the main Act and it should bring up all the amendments & additions i think

Find someone with access to LexisNexis to have a look? - failing that, the Act should be on the net somewhere plus amendments. Your local library may also have reference copies.

There's a couple of websites that do this but the ones I know of you have to register (and pay for) I think.

www.opsi.gov.uk has all the original acts but it doesn't tell you about the amendments.

Do you have access to Lexis via work or University? There is a database called Legislation Direct which you can use to find out which sections of an Act are in force, or have been amended, or the date on which any pending amendments will come into force.

If you don't have access to Lexis, you could try ringing your main central library and asking to speak to their law librarian, they should hopefully be able to look it up for you.

although a bit unwieldy. You'll see from the note at the top of the Act that there are changes effected in 2006, 2007 and 2008 which haven't yet been consolidated into the main act. You'll need to click on the table of legislative effects, put "2006" and number "21" into the boxes for "affected legislation", and then search for each of those years. that will bring up a list of the pieces of legislation that effected amendments, and indicate which provisions were amended. You can then search for the amending legislation.

Is there a particular provision you're looking at?

OFSTED have said that a total 3 people working together means we can't be childminding

The Act say 3 at a time working together can be childminding

those are "bringing into force" provisions. Some provisions came into force on 20 December 2006 (see link here and some on various dates in 2007 (see link here

Hmm - looks as though section 96(5) (which I think is the provision that you're referring to) is not yet in force. see here. I'm not sure what provision of the previous legislation currently governs the situation / if/when section 96(5) is scheduled to be brought into force - will have a scout around and see what I can find.

Both the Act and the explanatory note to the Act say that three people is childminding (the Act by saying it's not childminding if the number exceeds three, and the note by saying that "An early or later years childminder is someone who provides early or later years provision on domestic premises for reward with no more than two other people.")

So only 3 physical people are there at a time - but those people can be up to 6 different people
