Tax credits overpayment / end of TC

Orangesandlemons77 · 29/12/2024 15:14

Our tax credits are ending and I have had a letter saying I personally owe them money from a joint claim for the last few years.

However I thought it was a bit odd because it only includes the most recent years (2020 onwards) but I thought we had an overpayment from years before that.

The issue was with my husbands self employed income, estimated earnings versus the actual amount in some years.

I am unsure why they have only included recent years and why it is just for me and not split as it was a joint claim?

Anyone know? Thanks

They will pursue all claimants for the full amount as both are fully liable.

I would think potentially there is a 4 year limit for raising an overpayment.

Ok so this 4 year limit might be why they ar focusing on recent years?

I know it was previously being taken out of the TC payments and would transfer to Universal credit if we are to claim that if not it goes to DWP debt management

I have contacted the latter and they do not have the details yet but have told me I can arrange a plan which is manageable with them

Dh and I are both on the claim, wonder why they are just asking me then.

I've had tax credits chasing me for a joint claim from 2009, every year like clockwork from some debt collection agency, I'd ring up and bounce it back. I paid my half but my ex just refused to pay his and in the end I paid it a few months ago. Can't be fucked with it anymore.

So again, my ex has got off with no CM and stiffed me with overpayments with no penalty.

People keep saying there's only so far back then can go but that's been bollocks.

Even if you're both on the claim one person is the 'claimant' the other is 'partner'. I'd guess that you are the claimant therefore all letters should be addressed to you.

They address some letters to both of us, this one was just to me,

I'd like to ring TC and ask about it but don't want to bring up the previous years, daft really.
