Not sure about the protocol

My husband's parents died recently. They left him everything. The executors of the estate are a company. My husband is in a care home, but has mental capacity and has given me permission to deal with correspondence from the executors.

The executors are applying for power of probate. I understand my in-laws took out a considerable amount in loans against the property and these debts still have to be repaid.

My husband has a contact who would like to buy part of the estate (or perhaps even all the estate). The contact is able to pay immediately if the sale could go through. This contact has asked me to get in touch with the executors to see if they will negotiate.

I will get in touch with the executors, and see if they will correspond with the contact. My husband has given permission for this. However, I would like to know if my enquiry may be a bit out of place, or if it could be an opportunity to clear things up quickly.

Any thoughts would be welcome.

Not sure exactly what the issue is, but I believe probate has to be granted before a property is sold.

Is your husband capable of contacting the executors and giving them his views personally?

Do you have any form of Power of Attorney for him?

Get a PoA from your husband then you can handle everything, but the suggestion is perfectly valid. We had something similar when an aunt died - someone expressed an interest in buying her house at market value which of course saved on estate agent fees for the estate.

Thank you for these replies. My husband has given written permission for me to deal with any correspondence from the executors. I have consulted with him on this matter and he wants me to contact the executors. I will do this tomorrow.

Is it a power of attorney for financial matters he’s given you? You’d be best having that as an official record you can act on his behalf as this is involving his inheritance.
