UC disability element

Hello,

My adult child doesn't live with me. The currently get £300 approx UC per month but have applied for the Disability element. Is this the the "low capacity for work"? If so, is it a fixed amount?
Also, is it backdated?
They've had one lapse of their fit note where they forgot to renew it but have had fit notes for several months.

Sorry I just don't understand the system.

There is no adult disability element on UC only the LCW/ LCWRA element. LCWRA if awarded gives an extra £414 a month on the claim. LCW is no extra money. It is not paid until three months after first sick note was submitted. It could be a problem if a sick note lapsed, not sure what would happen in this situation but they usually expect them to be submitted without a break. LCW stands for limited capability for work, LCWRA stands for limited capability for work and work related activity. If awarded the former after assessment they may be expected to still attend some work related appointments with a work coach.

Have they claimed and completed the form and sent in their fit not from the gp? Have they provided their evidence ? Have they had an assessment? …..it’s all decided after this…..it could be they just get the same amount but then don’t have to actively look for work ……just depends what group they are assessed as being in

They have sent several fit notes from GP or psychiatrist and sent back a form that they filled in with support.

It's just a waiting game now for an assessment then unless they don't need an assessment. this sometimes happens if enough medical evidence has been received but more often than not people have a phone call assessment.

The £300/month sounds like the Standard Allowance - what UC pays for people to keep fed and clothed etc. It's £393.45/month if the claimant is over 25.

Under 25 it's c£311/mon5th 'cos obviously young people eat less, need less warmth and run around in the altogether.

If the claimant has a health condition that prevents them working they submit a fit note. Doing so triggers a Work Capability Assessment the first stage of which is to complete a form UC50 about how their condition affects them. That's usually followed up by an assessment by a DWP appointed Health Care Professional.

Outcome could be:

  1. Fit to work
  2. Limited Capability for Work; might get into the workforce with support and expected to do stuff to enable that. No extra money
  3. Limited Capability for Work and Work Related Activity; unable to work full stop. UC adds £419/month.

If 3 applies the extra money starts in the 4th assessment period after the one in which a fit note is filed.
