Does anyone know about the laws over Statutory Sick Pay please??

Hiya,

DH gets 1 week per year paid sick pay.

His doctor is seriously considering signing DH off work.

We have contacted jobseekers and they said its down to the employer to pay him whats owed (just days I assume) and then what happens?

The person at DWP said that the employer could be obliged to pay him up to 6 months full pay??

I cant see this happening if his contract states 1 week paid sick.

Any ideas?

Hi Disenchanted, I don't know for sure but hope one of the experts will be along soon.
I think if his contract is 1 week then it is unlikely to be anymore, I don't think any company is obliged to pay full pay.

i think and i may be wrong that he should be entitled to about £70 ssp

No, the employer is not obliged to pay anything except SSP, which is about £70 a week, the person probably meant the employer is obliged to pay 6 months full SICK pay, not full pay. It sounds like my company - 1 weeks pay and then you are stuffed!!!

My company also treat you like dirt if you call in sick, and docked my Xmas bonus as I had been off sick when pregnant, he has my sympathy!

It's possible that they will only pay for one week, then it will turn to ssp, which is not enough to live on. I was ill and needed to claim a few years ago. I was paid £8 a day ssp! I couldn't pay my rent or childcare. I was really stuffed.

Not sure why DWP have advised he could get 6 months full pay. I expect they meant SSP, as herecomethegirls said, it seems to be a bit of a misunderstanding.

I expect his policy is one week full pay, what's called 'occupational sick pay', then it will go to SSP.

I know you said his employers are basically bastards, but if it's a genuine longer-term illness some employers do use a bit of discretion and extend their occupational sick pay period - don't know if that's the case for him? They are under no obligation to though.
