communication problems with the Inland Revenue

I've name changed for this but would be really grateful if you anyone could offer any advice for me.

We live abroad. We informed the IR of this at the time of our move, telling them that as of Jan 07 we were living in another country, that we were no longer working in the UK, and asking them to stop any payments (Child Benefit, Tax Credits etc) to us as necessary.

It took a while before their correspondence suggested that they had understood this information, because for a while stuff was being sent to old address, and their request for information for the tax year still showed our old jobs. We assumed it either took a while to get through the system or they never got the first communication.

During most of this period we didn't have a phone at home and depended on mobile phones here as a means of communication (long story! ) so we always corresponded by unregistered post and sometimes by email where it was possible. I only have proof of email correspondence unfortunately.

So to try and cut a long story short, where we thought everything had been sorted and all in its place, I have just been to check our bank account in the UK, which we rarely look at, and it turns out that they are still paying us child benefit, 14 months later. Now obviously this is incredibly stupid of us not to notice but everything else suggested that they were aware we were no longer in the UK and were not entitled to Child Benefit. We had savings in that account and have gradually made our way through it, using it to start us off here and to cover some unexpected problems that came up during last year. So to make things worse the overpaid child benefit doesn't even exist in that account to pay the IR back, and we are far from being in a position to pay it back.

I know we should have noticed but shouldn't the payments have stopped an awful long time ago? What on earth can we do about this? Do we have a leg to stand on at all?

This is the worst news we could have now, financially. Am taking very deep breaths but this is major stress time.

OK, well, first of all if we're talking standard child benefit then it's not an enormous sum is it? Secondly, have the IR noticed? Thirdly, I would check the rule re child benefit and make sure you're not still entitled to it.
Really, I think you're worrying more than the situation warrants. and if you do owe it the IR will allow installments etc to re pay.

And this is very naughty but I have a friend (really, it is a friend!) who didn't keep copies of a letter to the IR, which the IR said they didn't get so the friend re typed it, hole punched it, photocopied it and sent it. They accepted it as proof of the letter havng been written in the first place. The friend was an accountant too . Not that I'm suggesting you do the same...

It's standard amount but over 14 months that's about £980, which is really tons for us. I'm pretty sure they will allow installments and that I guess that will have to be the only way forward if we were not entitled to it, but ouch! Such a stupid situation for us to end up in, when we are normally so carfeul with money. Argh.

Been trying to find out whether by some strange loophol we were actually entitled to it all along but so far haven't found found the right page on the IR website.

They definitely haven't noticed or they would have stopped it a long time ago - surely?

I've got a copy of the last email from them where they confirmed they understood we were not residents and confirmed they had the correct address. In the one before I had said as far as I was aware the last CB payment had been the month we left. Bugger.

So far I have found nothing connecting child benefit and emigrating but it must be there somewhere

anything here? look at rules re ordinarily resident.

I really think it's not as worrying as you think! You may be entitled to it even and if you're not then you probably have time to re pay it.

If you moved part way through a tax year (Jan 07) could you be entitled to a tax refund for last year?

If so, you could use that to offset the money you owe in child benefit although since no govt depts seem to communicate with each other, you would no doubt have to claim one and then pay the other. But it oculd help your ifnancial hole.

Also you were entitled to it for 8 weeks after you left the country, weren't you, so you can knock 8 weeks' worth off what you owe

thank you SueW for the link (off to look now) and yes, had found the 8 weeks' thing this pm. Good thought on the tax too - will check on that. And you are absolutely right - they don't seem to talk to each other - why??
