Does LCWRA show as a separate element on UC statement?

I have an existing claim for ESA (support group) and this has been deducted from my UC amount (albeit at around £50 more than I actually receive!).

Theres no LCWRA element on the statement. Should this show? I understand this element has an addition of around £390.

It’s a new claim for UC but my support group status pre dates the claim , so presumably the 3 month wait does not apply and this should be added straight away?

I has esa support group before my uc started, just looked back and got the disability bit from first month (back in 2019). When I had to transfer over from tax credits due to change in circumstances.

Hi op what elements of UC are on the statement? You should have a Standard allowance of £385, then any child and housing elements listed. If you are in ESA SG already (I am assuming new style based on NI contributions if you are still getting it), then you should have LCWRA and then have the ns ESA deducted £ for £ to as unearned income.

As it says in the link if you are on NS ESA and in the support group you get LCWRA automatically and you don't need a further assessment. Challenge the decision if they say you need to fill out a UC50 and get assessed again.

Thanks for the prompt replies.

Elements included are:

standard allowance (couple)
housing
carer (DH is my carer but he works and does not receive CA)

There is no mention of LCWRA for me, but I have a reduction for ESA. (Yes it’s new style).

Should the statement show a LCWRA element in the breakdown?

If it is not showing an additional amount for LCWRA then there is an error in your UC.

If this is your first payment call Citizens Advice Help to Claim then can help with these issues, do a benefits check to compare with what you are getting. Report the issue through your UC journal and if they say you have to wait 3 months or go through an assessment then go through Mandatory Reconsideration of that decision as it is most likely that DWP have made the error.

@FlemCandango thank you . Yes I think it’s been an error. I’ve left a message on the journal.

I really hope they don’t insist on a re assessment . I’ll take a look at the link you’ve posted. Thank you .

@MeSeeYouSee anybody receiving Support Group in ESA, whether NS/CB or or Income Related should automatically be have the LCfWRA addition in UC. The Regulations are specific about this.

Usually it's straightforward but there can be problems. As above if this is your first payment and it's not right you're still in scope for Help to Claim 0800 144 8 444.

MeSeeYouSee · 03/02/2024 13:53

@FlemCandango and @Bromptotoo very helpful information thankyou. I’ll await a reply in the journal. Hopefully I won’t need to push for it to be added automatically.

Hope you get sorted.

Just to note about what you said in your OP about being deducted £50 more than you receive.

You haven’t, it’s because ESA is paid weekly and UC is paid monthly.
ESA is 129.50 per week*52= £6734
then divide by 12

MeSeeYouSee · 03/02/2024 16:28

@thisfilmisboring that makes sense; thank you for explaining.

Hi, hope you can help. I have been awarded LCWRA, my sick note was accepted July 1st. I am now told that the 3 month assessment period is longer as they have not 'computed' yet. How do I get a coherent answer from them. No reply to my message journal

BabyR · 09/10/2024 19:04

I have just migrated from ESA support group to UC and I’m so anxious about the whole thing.

Bromptotoo · 10/10/2024 13:24

@SheriG what are the start/end dates for your Assessment Period.

The 'relevant period of' 3 months starts when you provide medical evidence. LCfWRA is payable form the first AP after those three months end.

I have just migrated from ESA support group to UC and I’m so anxious about the whole thing.

It works fine for most people.

However for way too many folks there is a delay in getting the LCfWRA element in payment in AP#1. Anecdotally that's because of delays in information from ESA finding its way to UC.

There are also problems with Job Centre front of house staff not understanding the DWPs processes. As a result people with in date WCAs putting them in the Support Group are being asked to provide fit notes and, in some cases, 'leaned on' to do work related activity.

Anybody with a migration notice is eligible for advice and support from the guys at Help to Claim until they've got a correct first payment.
