Am I entitled?

Dreadful thing happening in my life: it fell apart.
We have 2 houses with mortgages, DH left to live in the other house and promised to pay both mortgages.
I am left with 2 DCs and part time low paid job.
Can I claim UC in these circumstances? Do not need mortgage payments covered, but can not survive on my salary of £170 pw. No prospect of getting more hours at work.

Are you named on both mortgages? Even if dh lives in one and you’ve split I think they take that into consideration and that will count towards ‘savings’ which will wipe out any UC claim.

No this is incorrect, second homes are 100% classed as ‘savings’ and the value of the house will be used. Unless it’s a £15000 house op’s claim will be wiped out.

Second homes are classed as savings, so I'd imagine it's unlikely. Put a claim in anyway it's worth a shot but most likely you will need to sell/come off one of the mortgages to be entitled.

I would be very surprised if that was the case, otherwise this would be totally exploited by couples who are actually still together (not like the op) to end up owning two houses one at tax payers expense.

If you have your dc full time op and thus can't work as I'm presuming they require care, then he will need to pay you child maintenance. But not the mortgage too.

In brief, the house you live in will be disregarded. The one your husband is in, assuming your name is on the deeds, will not.

However, there are circumstances in which it can be albeit only for a limited period - although that can be extended.

One is if your taking steps to market it. Another, if the STBXH doesn't want to sell up is that you're taking steps, for example getting legal advice, so as to liberate your share, for example as part of divorce.

Earlier post was while out and about. Now checked with a professional calculator and, provided you can sort out a disregard for the house your husband is in, UC would be around £850/month.

Further thought is that the house can be disregarded for six months after you move out. After that you can possibly use another of the exceptions set out in Schedule 10 of The UC Regs:
