1 yr old Open Motor insurance claim

Hi, I hope this is the right forum to pose this question.
My car insurance was with Aviva. Last year 17 Jan I met with an accident with Third party fault and No fault on me, already proven through police report and insurer confirmation of No fault.

This claim is still open with Aviva, just had 1 yr anniversary on the incident. , they keep saying they are pursuing with the other party insurer and they can’t close the claim until they have recovered the money from other party insurer.

in the meantime, I moved to Admiral as part of renewal. Admiral is charging me exorbitantly higher premium as I have open claim against me.

so in all this, I’m the person ending up paying more despite No fault on me. I feel prejudiced and unfairly treated.

what are my options.

i have written another complaint email to Aviva asking them to respond within 10 days else I will raise complaint with FCA and financial ombudsman.

any thoughts from anyone who may have faced similar situation.

That’s so wrong why should the No faults party face such unfair treatment. You must be refunded wholly. also it’s not about the refund. I’m currently having to shell out more that has direct impact on my cost of living.

I have this with Aviva too. Our accident was in Summer 22 and still open as the person who crashed into me is lying and saying I crashed into her. My car got written off. I had to stay with Aviva in the end as every other insurer was too expensive.
