If some ones owns a house outright before they were married, can the spouse still claim half of it ? Or would this be counted as an asset that the spouse brought in to the marriage and therefore can't be claimed?

Is it a long marriage? I think that makes a difference.

As a previous poster said, it depends on the length of marriage. Although the court will most likely say that the spouse will have some claim on the property.

One of my friends is currently divorcing her husband after 18 years. Her solicitor says as this is a long marriage she has a claim on all his assets (which are substantial) and that the starting point is a 50/50 division. He's wealthy, stubborn, and likes to be in control; it's not going to be pretty.

It's are ten year marriage and they don't have children together. I always thought that any assets brought into the marriage such as property owned outright could not be considered

I took part on an online session run by two lawyers for women on legal matters and they said if the home one owns is used as a family home then the other party can claim.
