Chancel repair liability.

We are in the process of selling our house and we received a letter saying the we need to provide indemnity insurance. I bought the house in 2004, should our cnveyancing team have picked this up then? If not how much is this insurance and am I obliged to pay. If we are talking £50 quid I'll pay just to expedite matters. Any info or advice please.

Can be anythgin from £50 upwards dependign on what they have to cover. Solciitor/conveyancer can organise it.

We had to pay indemnity insurance when we moved in - we argued that the sellers should pay it as they should have had it in the first instance.
This went back and forth for ages and was starting to become a 'deal breaker' ......until we found out that it was £137 - and the estate agent paid it as he obviously was worried about losing his comission!!

Well I think first off you need to check whether it really is a potential liability. Your previous conveyancing team may have concluded that you couldn't be liable. The rate will depend on the likelihood of a claim. Probably low if you weren't already aware of the issue.

If you are liable for chancel repairs you should have been told when you purchased the house if it is stated on the title deeds. Check through what you were sent at the time.

I think the premuim is more likely to be £150 - £200 depending on the value of your house. What does your own solicitor say on the point?

If you had had one for your purchase in 2004 (which you may not have realised) you should be able to pass it on

I don't remember any info about this when we bought. My solicitor said it would cost about £125. Bit miffed about not being told in 2004.
