what's the £200 for?

How much notice did she give you to leave?

mace · 04/03/2008 20:27

she didnt give me any notice to leave just brought loads of estate agents around and sold the house. She then said the sooner I move out the better so I found another place to live and agreed to move in this weekend, I rang her and she said we had agreed to move out on the 27th march and if I was to move earlier I would loose my bond or if I pay another 2 weeks rent (£200) she will give the bond back if the house is up to scratch. She told me that the person who has bought the property isnt sorting the mortage out untill I move out and she doesnt want to loose money I have no written notice to move out and she keeps turning up at my house.

  1. Bonds are protected now - she can't just take it without reason.
  1. If you have a contract/rent agreement (you should have signed something when you moved in) she can't just chuck you out with no notice.

BAsically get down the council or CAB. Take copies of anything that she has written (contracts/agreements/letters). Make a fuss.

Have a look here www.direct.gov.uk/en/HomeAndCommunity/BuyingAndSellingYourHome/RentingAHome/DG_4001366

I'm assuming you have an assured tenancy.

And

will have to download guides

Doublechecked here www.direct.gov.uk/en/HomeAndCommunity/BuyingAndSellingYourHome/RentingAHome/DG_10020862 and yes your council can help with unlawful eviction so get on to them.

Agree with ArmadilloDaMan, get yourself and your lease down to the CAB office or alternatively ring Shelter

With your bond if you took the tenancy out after 1st April 2007 ( I think that was the date) then she needs to have protected it in one of the government schemes. If she failed to do this you are entitled to claim three times the deposit back for her for having failed to do so.

She is also not allowed to just turn up when she wants to and arrange for estate agents to come round when she wants to. There is a set procedure she needs to follow with regards to giving you notice. Basically she sounds as if she is taking the mickey.

Good luck mace. I think I'm right in saying if she has failed to give you written notice then you don't actually have to move out. It has to be two months notice served on the day your rent is due ie. if you pay from the first of the month and she serves you notice on the 5th of the month, then the notice period of two months won't begin until the first of the next month. But definitely check that out as I could be wrong.

how are you getting on with this.
