Not Paying CSA

To cut a long story short, I Kicked my husband out of my property almost 2 months ago. He is controlling, mentally abusive plus other factors. I also found out he was having affair, he decided not to come home for a few nights, and stupidly post a picture of him and his new GF (lives abroad) together. I changed the locks.

He has not paid anything for our son and only seen him 4 times since July. Doesnt have him over night. He wont pick our son up from my parents if they are looking after him. He said he cant afford the petrol. Its a 30min drive to his place from my parents, but can catch a 10 hour flight to see his GF, which he has just got back from again.

He wont pay for CSA because I kicked him out. Is that true? He works but half of wages goes in the bank and the rest is cash in hand.

Please help

Apply to Child Support Maintenance for him to pay - half of his wages for a CSM calculation is better than zero you're getting now.

If he complains just say you've have to as its a duty to your dc. Let them sort it out rather than you two doing it.

As Mike said… and I’d also have a word to HMRC if he’s not declaring all his income.

(I’m assuming it’s not declared, rather than literally just paid in cash but legit. If it’s the latter CMS will still include it)

Thank you. Main concern is that i kicked him out, he said they wont back date it as when he left - or in his eyes he didnt

CSA will only backdate to the date you opened the claim, so you need to get that started ASAP.

As PP have said, if he is hiding income, you can report that separately to HMRC.

They will backdate it from when your start the claim so you need to apply asap. That you kicked him out and when you kicked him out will be irrelevant for the claim. If you can get any evidence of his cash in hand work that will help.
