How to get my money back ?

I have lent money to a friend that I am struggling to get back.
I have been very patient but I cannot afford to lose this money
if the worst comes to the worst can I apply to the courts , I’m not sure of the process
would I need to employ a debt recovery company ,

any help gratefully received.

It’s definitely a loan , and I have text where we discuss it , but after lots of promises , no money actually materialised

We have agreed an amount per month to start aug but I have had this before and then there is excuse after excuse

Also keeps saying is due some money ( which is yet to materialise) and will pay in full when gets it

I have just been reading on gov site re small claims so thanks for pointing me in that direction,

lesson learnt , never again , and I’m sad that it may come to this

I think you need them to default on the repayment arrangement before you can claim

Wow, 4k? Definitely through court.

That's not a sum that they'll even come close to paying off even if they are 'due some money'.

I have a friend who wanted 1000 for a holiday but said she could only pay it back at 50 a month... if that's all they can afford as a repayment, they shouldn't be going on such a holiday!

it’s not only about the money
I feel I have been manipulated and lied to , and duped , I did this in good faith and now I just feel like a mug .
but regardless, I will go down the legal route if I have to .
I will send a detailed mail stating monies owed and agreement terms ( well the latest terms ) this weekend , ready to provide to the court if they default .

so sad about it

Well in a surprising update I got a decent chunk back in sept £400 and an agreement to pay that each month ,,, except nothing this month except excuses . The money she was due hasn’t materialised quelle surprise, sh offered a smaller amount per month starting nov but 🤷‍♀️
so now what ?

I think you need to accept that the friendship has gone. If it was me, I'd send another mail back reiterating the payment schedule and give her a deadline to pay this month's instalment. If nothing appears, small claims.

I can imagine. But you can rest assured that it's not your fault. You lent her the money with the best of intentions and she blew it.

Aah, I feel your pain. I was really close to a friend at uni, and she was really struggling to get to placement. I lent her money to get her car fixed, she paid whilst at uni as soon as we were done she blocked me. This was 5 years ago and I'm still angry. She's a nurse, wouldn't want her looking after my relatives the theif x

I'm sorry that you're going through this.
My 'friend'/ beggar/thief stung me for a much smaller amount but significant nonetheless.
My problem was that I'd got no proof. It was cash over fist.
If I'd got a single text acknowledging this 'loan' I'd have taken her to the small claims court.

You will need to provide evidence it was a loan and not a gift in order to claim against her. If you don't have the
It written down anywhere you may be stuffed.
