Mortgage overpayments

My husband took out the mortgage in his name because I wasn’t working at the time. I am marked on the mortgage as living there. Now I am working self employed and we are thinking of using what I earn to overpay the mortgage earlier. We are married with children.

i just wanted to know thoughts are on this in case we were to get divorced. Whenever we have an argument my husband is quick to say I wouldn’t get anything on the house etc he can be quite aggressive about this. So i wonder if it’s a good or bad idea to use my earnings to overpay the mortgage. I suppose at the very least this should be going directly from my account to the bank so that it shows I have been paying the mortgage as well.

Are you on the deeds?

MonkeySeeMonkeyDoMonkeyDont · 21/06/2023 22:48

Why does he think you wouldn’t get anything if you divorce?
Why are you staying with someone who threatens that you will be destitute if you break up.

Your H is talking absolute rubbish. You’re married and if you divorce ALL assets are brought together and considered in the financial settlement.

To be honest, he sounds horrible.

If you want to over pay do it straight into the mortgage account rather than his bank account to prove your contributions. But you're married anyway so it's a joint asset whoever's name is on it. Those are nasty threats from him though, perhaps you need a post nup or a deed of trust

You shouldn’t do anything without being on the deeds - if he agree tot he overpayments there is nothing to stop him agreeing to changing the deeds.

Therr can be issues - DF married - he’s moved out, new woman, been gone 10 years.

Here’s the issue, as he owns the property she can not force a sale, although he can. As the owner he is responsible for the rates etc, and refuses to pay them. She can’t claim help with rates as she doesn’t have a rental agreement.
She can not move house - she can not sell something she doesn’t own.
She can not afford the upkeep of the property and he has not interest in doing so.
The mortgage is paid off and she can not get a council house because she is housed.
She can not I sure the property - only contents and he won’t say if there’s cover - even if there was she couldn’t claim because me it’s in his name and they won’t speak to her - there are other issues!!

Tread carefully.

So what I have decided is to keep the overpayments in a savings accounts in my name and when the time comes to refix the mortgage term in about 2 years, we can decide if we want to use it for the mortgage or for investing. But I will say to him if we use it for the mortgage he would need to add my name to the property/ mortgage . Could this be done? I know he will say that mortgage wouldn’t allow me or it wouldn’t make sense for whatever reason.
I wouldn’t say anything about it before hand because I know he would make it so it’s impossible for me to save money by stopping paying for things. I know he sounds bad here, 99% of the time we get along great it’s just once or twice a year we have an argument and then these things come up.
