My auntie is a alcoholic, and tonight my cousin had to call the police as she got violent and out of control, it took 5 of them to restrain her and she ended up hitting one of the officers (causing him a cut eye) any idea on what will happen? she has been arrested, she is in such a mess atm.

First offence btw, TIA

It will depend to be honest. She could get charged with assault on police (my DP is a police officer) and someone threw a phone at his head the other night when he was trying to arrest him, and he has been charged with assault.

However just because she has been charged doesn't mean it will go anywhere, she could just be released with a caution, esp if it is her first offence. Hope all goes well, and sorry I can't help anymore, DP is out and I am going by what he normally chats to me about!

assauot pc startsat low custody! its really seriousl aggraveted by alcohol, mitigated by her chrnic alcoholism aggraveated byt he wound

she will prob be reffered to a drink counsellor before the court apprearance which will help her and her case to attend tbh. if they dont run that shceme wiht you get her to go to one anwyay.

ask about a duty solicitor or employ one yourself. she wil need a lot of mitigation

Heard through the grapevine, that she was let out at midnight (i thought they would have kept her in till morning) and they have put it on her record but no further action. I thought assaulting a PO would be fairly serious....weird.

Cod, Have found out now, she is in court on the 10th March, any ideas?, apparently she is quite frightened as to what will happen.

Is there any chance she could get time for this? first offence, but the officer did end up with a cut eye.

From what Cod said above "starts at low custody" it does look like she might get time.

Hi Pucca - am also JP so might help = if she pleads guilty at the first opportunity (i.e 10th March) she will almost certainly be referred to probation for a report to be prepared. That will assess everything about her, including her alcohol dependency and how likely it is that she will respond to treatment. The guideline is custody, but a community penalty is much, much more likely: she may get ordered to undertake alcohol treatment, for example, and attend regular supervision appointments. She may also have to pay compensation to the officer.
