How to bank cheque made out to Executors of...

My dad has had a refund from Eon and I need to bank, however it is made out to the Executors of <his name>

It's for over £5k, i was going to bank it with the cash machine but now wondering if I could do that with the name as above.

I am the executor and probate is still going through, any advice on what I can do? i will try to call them I suppose tomorrow but can't get to a branch as I am working and they open late and close early.

Do you have a document confirming that you are executor (such as a will)? If so then you can possibly take both to your bank with ID?

Following. I’m in the same boat. The will has gone to the probate people so I didn’t my even have that.

You should have an executorship bank account for this. You can’t deposit it into your personal account.

They’re sometimes called estate accounts. Depends on the bank.

I was Executor for my late father in law, I got cheques that I just paid in, but they did have my name on cheque, ie joe bloggs executor of mr bloggs. But for that amount I would visit a branch with a copy of the will, which hopefully you’ve kept.

i have a copy of the will, but as honeyroar the original has been sent to the probate office, I could print out the copy and take that in. Other refunds have just been made to my account by Bacs.

I thought an executor account wasn't a necessity.

You need an executors account. The bank will help you open one and it with be 'executors of 'deceased names'. The money is never 'yours'. Really advise you keep it separate, for audit and tax purposes. If you are a beneficiary you'll just then pay yourself from it.

i have all money in a separate account and am, of course, keeping records of all transactions. I am not thinking the money is mine at all.

As i said all previous refunds have been straightforward. Research says that a executor account isn't needed.

Your separate account should be an executor account. If it's in your name, all the money is legally yours. Should it be at this point?

I got the company to reissue it in my name with proof of will. i think the bank would've dealt with it in branch too tho. Didn't have an executor account just a separate one.

Executor accounts are not compulsory and are quite hard to get now. Take a copy of the will plus ID and make sure you keep records.

You’ll need death certificate as well. Getting an estate account was easy as of September 2021

You need an executor account, really easy to set up if you go into the bank, take the will which names you as executor and a copy of the death certificate, I was recently executor for my DM, when probate is granted take a copy of the certificate into the bank and they change the account into one in your name so you can distribute the funds

I had this problem with a TV license refund. I bank with First Direct who told me that they didn't do executors accounts, nor would they let me pay it in to my personal account even with proof of death etc so I had to get the cheque reissued in my name.

Didn't think TV Licensing would agree but they did.

Perhaps things have moved on, but when my parents died a few years ago one of the first things I did once I had the death certificate - long before applying for probate - was to convert their bank accounts into executor accounts. Any refunds etc were paid into that.

You dont need an executor account and most banks don't generally do them anymore as they are a pain in the ass from a money laundering and other compliance perspective. Not worth it for £5k. Contact eon and ask them to re-address. They should have a small estates form you can fill out.

Eon will not issue me another cheque and no banks can offer an executor account. Eon have said I can do a formal complaint that will be escalated to the ombudsmen. I am at a dead end with Eon who have been really unhelpful.

This sounds wrong to me. Perhaps ask Age UK how to go about getting a suitable executor account.

If you google executor account, lots of banks have explanations of how to open one (Nat.west, RBS, Barclays, HSBC...)

I used an old empty current account of mine when I did mum's estate. It may be that you will have to wait until probate comes through then your bank should accept it with sight of probate.

I have spoken to the bereavement team at Barclays as I too have the same situation and initially they said I would need to open an executor account, however to bypass that they said I could ask the company to put my name on the cheque, ie ‘my name, executor of deceased name’ and that could be paid into my personal account. The other option they suggested was I could ask the company to make the cheque out in the deceased’s name and even if the deceased’s account has been closed, I could pay the cheque into that account within 6 months of notification of closure and the money will then be transferred to my personal account. I hope this helps.

i did manage to get this sorted. I spoke to the citizens advice on the recommendation of my bank and they had a dedicated person who deals with suppliers. She was very helpful and I did manage to get a cheque made out in my name and it has cashed. it seemed like a lot of hard work and stress to do sort though.
