Not sure if I’m posting in the right place, but hoping to get some clarity.
My parents have made a will and put my married name on, however I didn’t actually change my name and still go by my maiden name. Would this be an issue? It’s possible I may change my name at some point down the line, but if I don’t would my marriage certificate be enough proof when the time comes?
I don’t want to mess them around changing things if it’s not necessary.

I’m not a lawyer but I’m pretty sure this won’t matter. The wording of the will should be something like ‘and to my daughter Mrs X Y of Current Address’ and the fact that you are their daughter and are married to Mr Y should be sufficient.

@NoSquirrels thank you. This is what I was thinking, and there is a note to say that if I changed my name or address in the future it wouldn’t normally require a change in Will. But I just wondered if it made a difference if I’ve never been officially known by that name - I don’t see why it should, but it was just a niggle

I think the thing about being married is that you are perfectly entitled to call yourself Mrs Y if you wish - so the fact that you don’t use it, or have any official documents in that name, shouldn’t matter.

It shouldn't matter if you're down as your maiden name. You're still their daughter. We made our will before DC2 was born so couldn't put a name in.Our will stated DC1s name and any other children as beneficiaries

Who is the executor ?
as getting a cheque in the wrong name is really hard to put in the bank. Even with a marriage certificate.
I use my maiden name to work, but all my accounts are in my married name and I got a cheque from work and in the end had to ask them to re write the cheque. The banks would just not accept it, and the hours I wanted trying to put a small amount of money was just not worth it.

If you are the executor it will be really easy to get the name right 😀

It’s me. So I’m a bit in limbo now because I have been debating recently whether to change my name or still keep my maiden name.
Am I allowed to have bank accounts in different names? I guess this would solve the issue if I have an account to deposit money into either way.
Obviously hoping it will be many years down the line before this situation arises, so it’s hard to know right now what to do for the best

If it is you, you make the cheque out to yourself in the name on you bank account and enter it into the executor accounts ledger as Cheque to ABC also known as XYz, which is your husbands name .
Easy to do. So stop worrying

isthewashingdryyet · 25/04/2023 10:25

Banks like the same name on your passport and driving licence, in my experience, so prefer you to only have one surname 😀

Chasingsquirrels · 25/04/2023 10:28

In reality, you are more likely to make transfers than write cheques!

I opened an executors account yesterday to deal with my parents wills. We only receive a cheque book to make Payments to the beneficiaries.
we were told you cannot use internet banking or have cards.

I had fun and games when a US cheque arrived payable to Mrs XY where X was my maiden name. The executor (Southern state small town lawyer) had just assumed that I’d follow the US practice. Luckily the bank accepted my wedding certificate and explanation.

We had a name error and needed to get something witnessed/authorised to prove I was the right person
