Additional Property SDLT For Couple When Replacing Main Home.

I have a stamp duty on additional property question.
A lady owns a ppty [ppty A] worth £250k, lives in it over 2yrs, meets prince charming who owns one ppty [ppty B] which he lives in.
They marry and she moves into ppty B owned by husband who owns 1 ppty for a few years.
Here comes the SDLT question, after a few years they then decided to buy a large family home to start a family [ppty C] mortgage free from sale of husband's ppty B [which is their main home] and his savings.
Please note at the time of buying ppty C husband is selling his one and only ppty B while wife still holds on to her ppty A.

  1. Will the 3% additional surcharge be due if ppty C is bought in both names? Even though the husband is simply replacing his only ppty and their main dwelling?
  2. Will it be due if bought only in husband's name? Ie he will have no other property on completion.

We were told no additional stamp duty when we did that as the main residence was being replaced.
