Once someone is deceased can you view their will?

My Father died over 10 years ago and I want to see his will. My Mother has always said that he left me and my siblings joint ownership of a property in France. My Mother is not communicating with me.

Does anyone know ..

  1. how do I confirm this by viewing the will?
  1. How do I sell my share of it if they dont want to sell it?

Yes the will is public property, see information here about accessing it.

Don't know the answer to your other question I'm afraid.

Provided his estate required probate then you should be able to get a copy of the will (I think)

the second part of the question is basically how do I get the financial asset out of the property? I just want to cover all my avenues before I approach my family (because I know it will be a battle, too much for them to handle)! the property in France was bought about 15 years ago and no one ever uses it! My husband and I offered to handle leasing it out as a holiday flat but that was too much hassle for my Mother. One year the pipes froze and caused an awful mess then 4 years ago I went to use it, (the one and only time), and there was a squatter living there and we had to get the police in etc. My Mother has to pay the taxes and basic utility costs etc and I think it is a liablily not an asset and I want my part out.
any ideas what I should do? and where do I stand legally as far as insisting that we either sell it or pay me my part??

There would normally be a clause in the will to say that if either of you wants to sell, you give the other party first refusal.
